WHY WIBA INSURANCE?

Is safety on the job your top priority? Accidents in the workplace do happen. As an employer, it is your responsibility to ensure your workplace is safe and that you obtain a Workers Compensation policy that adequately covers your employees in the unfortunate event they sustain an injury at work or become sick because of work.

Could you imagine getting hurt on your job and the only thing you could do was to sue your employer in order to prove that they were at fault for your workplace injury? That is how it used to be in the early 1900’s.

Back then if someone got injured at work, they just had to deal with lost wages, find another job or live with a permanent disability. This was because people had to prove that the injury was due to an unsafe work environment and to do that you had to go to court.

Most workers could not afford the costs associated with suing their employer. Labor unions pushed for workers compensation insurance to protect employers. This resulted to all employers being required by law to provide some type of worker’s compensation insurance for their employees. In Kenya, this is provided for under Work Injury Benefits Act, 2007

  • What Is Work Injury Benefits Act (WIBA)?

    The Workers Injury Benefit Act (WIBA), 2007 is an Act of Parliament that provides for compensation to employees for work related injuries and occupational diseases contracted in the course of their employment. It repealed the Workmen's Compensation Act cap 236. The Act came into operation as from 2nd June 2008.

  • What Does WIBA Insurance Cover?

    WIBA Insurance covers employees of the insured whilst on duty and engaged in the execution of the insured's business and/or any project undertaken by the insured against accidental bodily injury, disablement, death or occupational illness.

  • What Are The Three Types of Compensation Under WIBA Insurance?

    Key Features. In case of death: Based on 96 months earnings subject to the maximum limit of liability. Permanent Total Disability (PTD): Percentages as set out in the First Schedule of Work Injury Benefits Act. Total Temporary Disability (TTD): As per the Work Injury Benefits Act, 2007 maximum 12 months earnings. The policy also extends cover to medical expenses and last expense as set out in the policy.

  • Is WIBA Insurance Mandatory?

    Every employer is required by the Act to obtain and maintain an insurance policy with an insurer approved by the minister (for Finance) in respect of any liability that the employer may incur under the Act with respect to any of their employees.

  • What Is The WIBA Plus Policy?

    Also denoted as WIBA/GPA, WIBA Plus is a 24-hour policy that covers accidental bodily injury sustained during or outside normal working hours while not engaged in normal occupational responsibility for your employees.

  • How Do You Report A claim of Accident?

    Every employer should report all occupational accidents to the Director of Occupational Health and Safety Services on the prescribed form (DOSHS 1) within seven days after having received notice of an accident or having learnt that an employee has been injured in an accident. In case of fatal accidents, the accident should be reported within twenty-four hours after occurrence by fastest means possible and thereafter through DOSHS 1 within seven days.
